Extending rights and protections in front of discriminatory and violent acts for reasons based on sex, gender and sexual orientation represents a need which fortunately is widely shared. However, the way in which this aim must be achieved is more contrasted: whether through the path of identity categorization or alternatively following that of egalitarian universalism. In any case, this need raises important implications of a philosophical- juridical nature: from the way in which one’s gender identity coincides or not with sex to the relationship between facts, perceptions and the public dimension. The category most called into question is however that of recognition, which we will investigate mainly through the words of Hegel and Judith Butler. In the background, the theoretical question of the subject (and its “crisis”, some would say), together with the theme of intersubjectivity interconnected to it. We will see in particular how the construction of our identity, including that of gender, in the dual dimension - horizontal and vertical - is a complex operation that crosses various levels: the biological, the psychological and the social one.
